Sub: Regarding judicial inquiry of the Batla House Encounter dated 19.09.2008

Sir  
          We are pained and disappointed to read the findings of the NHRC with regard to the tragic incident of Batla House last year. The report appears to be based primarily, if not solely, on a perusal of records submitted by the Police which is essentially the accused in the case under reference. We are surprised to learn that the august body failed to hold a publicized public hearing or to conduct an on-the-spot inspection of the place of occurrence in the presence of the residents of the locality. This has caused considerable resentment and disquiet among the local residents and the minority community generally.

As per news reports the National Human Rights Commission (NHRC) was requested by High Court of Delhi to look into matter [Batla House encounter case] from Human Right angle. On Wednesday NHRC gave clean chit to Delhi Police. The NHRC in News Briefing reported that ‘We are clearly of the opinion that having regard to the material placed before us, it cannot be said that there has been any violation of human rights by action of police.’

In order, therefore, to generate the confidence of people at large it is in the National interest to constitute an independent inquiry under the Commission of Inquiries Act so as to re-build public confidence and to instill a sense of security among the general public - Trust and confidence are the pillars of Democracy. If the confidence of subject is shattered the whole democratic system collapses. The matter requires urgent attention before the issue escalates into an avoidably emotional issue.
